Terms and conditions of the academy contract
These General Terms and Conditions of the academy contract are an integral part of the academy’s contracts entered into by the student or his/her legal representatives (parents, guardians etc.), hereinafter: “contract partners”, with Learning First British School SL (NIF: B42993535 located at Calle la Caridad 63, Tacoronte), respectively, hereinafter: “LFT”. They apply to all courses of study at LFT. By registering for a course of study, the contract partners declare their agreement with these General Terms and Conditions of Contract and are bound by them.
Certain services of LFT may be subject to separate terms of contract and/or registration form, which supplement the provisions of these General Terms and Conditions of Contract (for example, the camps and excursions abroad). These will be referred to separately in connection with the respective service. As these separate and special conditions for individual service areas deviate from the provisions of these General Terms and Conditions of Contract, the provisions of the special conditions shall take precedence over the respective provisions of these General Terms and Conditions of Contract.
1. Contract and obligations of the contracting parties
a. The academy contract is accepted by it being signed by both the contract partners and the representative of LFT.
b. The contract partners are jointly and severally liable for the obligations they enter into through the academy contract. This joint and several liability shall not be eliminated by any subsequent change in civil status.
c. The contract partners are liable for the obligations they enter into through this academy contract, even if the student comes of age.
d. The contract partners declare their agreement with the academy regulations, the code of conduct and the academy handbook.
e. The contract is a rolling contract and therefore will continue to be valid every academic year until the contract partners and/or LFT decide to cancel the contract.
2. Contract and obligations of LFT
a. Todos cursos de Learning First Tenerife son cursos académicos, por lo que tienen una duración de 10 meses (septiembre – Junio)
b. Los cursos académicos transcurren desde el 12 de septiembre 2022 hasta el 23 de Junio 2023.
c. Lessons shall be taught by qualified teachers using modern didactic and methodological methods.
d. LFT is responsible for the staffing and organisation of the lessons and LFT is entitled to change teachers during the term of the academy contract. There is no entitlement to lessons with a particular teacher, time or classroom.
e. Should an entire course of study be definitely cancelled, the fees already paid shall be refunded. Any reimbursement of further costs is excluded.
f. The acceptance of the academy contract is no guarantee of the attainment of the aspired educational goal.
g. LFT puede apuntar a sus alumnos para los exámenes oficiales de idiomas, de música y de matemáticas, pero se reserva el derecho de presentar a nuestros alumnos si nuestros profesores consideran que no están listos para presentarse al examen.
h. If it is necessary to change the methods of regular lessons (e.g. to distance learning) due to official instructions, pandemics, similar events or force majeure, lessons shall be deemed to have been held and there shall be no entitlement to reductions or refunds of school fees.
i. Los formularios de inscripción, de protección de datos, calendario y de orden de pago automático deben ser completados y firmado antes de asistir a su primera clase.
3. Updated tariffs/price list for new academic years
a. Course fees are amended and updated every academic year, they are based on the respective LFT grades achieved in previous years and are calculated accordingly.
b. The new tariffs for the new academic years shall be considered accepted and become an integral part of the rolling contract unless the contract partners terminate the academy contract for the forthcoming year by email or letter within the regular period of notice of three months to the end of the school year (24rd June). In the event of late termination, three months’ s fees shall be due according to the updated price list.
c. If a student joins the academy during the current school year, the academy fees are calculated pro rata.
d. Teaching materials are included and is covered by the registration fee (matríucla). Student books are not included and must be purchased before the contracted parties first class at the academy
e. The registration fee is non-refundable and will be charged 3-4 working days after the academy contract has been signed by both parties.
f. The costs of excursions, trips, school camps, exams, exam administration fees and certificates, as well as other additional services and activities provided by LFT, are not included in the course fees.
4. New student enrolment:
a. New students who enrol for any course at LFT have a 6-week probation period which will be counted in natural days (42 days).
b. A new student is anyone who has never attended a course at LFT in previous years.
c. If the contracted party choses to withdraw from the course within this period, they can cancel and will only pay for the classes that they attended.
d. The registration fee and any money paid for books will not be refunded.
5. Financial provisions/terms of payment
a. The registration fee (matricula) is a one-off payment paid at the beginning of the course and is non-refundable.
b. All payments will be made exclusively through direct debit
c. The monthly payment will be deducted from your account the first week of each month for the same month, between days 1 and 7. Payment dates:
• September 19, 2022.
• October 5, 2022
• November 4, 2022
• December 6, 2022
• January 6, 2023
• February 3, 2023
• March 7, 2023
• April 5, 2023
• May 5, 2023
• June 5, 2023
d. If your automatic payment is returned, we will try to charge it again within three business days and you will incur an additional charge of €6. Each time the payment is returned, a fee of €6 will be charged for a maximum of three times.
e. If one monthly instalment is not paid by the agreed payment deadline and if LFT have failed to collect the sum after three attempts, then LFT has the right to exclude the student from taking part in classes until all the instalments due have been paid. A payment reminder will be sent and a grace period of 10 days will be given to the contracted partners to pay make the late payment.
f. If payment has still not been made after sending a payment reminder and granting a grace period of 10 days, LFT may withdraw from the contract. In the event of withdrawal from the contract, LFT is entitled to an administrative fee (80€) and a cancellation fee of three months’ course fees in addition to the fee for the tuition provided. In the event of an enforced collection of fees, all the costs incurred shall be borne by the debtor (contracted partner). LFT shall charge an annual interest of 3% on the outstanding amount.
g. In the event of non- payment after the 10 days grace period, LFT reserves the right to instruct a debt collection agency or other specialised organisation (e.g. a law firm or debt agency) to collect the course fees.
h. LFT shall only register students for examinations if the course fees and/or examination fees due are paid in full at the time of registration.
i. If course fees have not yet been paid when the student leaves the academy, LFT reserves the right to withhold certificates and diplomas until these have been paid in full.
j. Missed lessons do not release the contracted party from his/her payment obligation; there is no right to reimbursement.
k. There is no change in payment arrangements e.g. from monthly to trimestral
6. Termination of contract for enrolment for a new academic year by contracted party
The academy contract shall be extended for a further academic year (rolling contract), unless it is terminated by one of the contracted party by email or letter observing three months’ notice to the end of the school year (24th June). The date of receipt by LFT is authoritative for compliance with the time limit.
In the event of late termination for a new academic year, the full amount of the school fees for three months shall be due.
7. Termination of contract during the academic year by the contracted party
The academy contract may be terminated by the contract partners by email or letter observing three months’ notice to the end of a month. In such a case, Academia shall be entitled to the full amount of the monthly course fees for the entire period of notice, even if the student is taken from the school before the end of the contract.
8. Extraordinary termination of contract by LFT
LFT may terminate the Academy contract with immediate effect and without notice if
• the student has grossly violated the academy rules or committed a serious offence
• the student repeatedly fails to attend classes without any notice
• other important reasons make the continuation of the school contract unreasonable for LFT.
In the event of the extraordinary termination of the contract, Academia is entitled to an administrative fee (80€) and a cancellation fee of three months’ s course fees in addition to the fee for the tuition provided.
9. Lesson times, school holidays and public holidays
1. LFT’s management shall determine lesson times and inform the contract partners thereof in writing in due time. The contract partners are responsible for ensuring that the student arrives at the school on time for the start of the lesson.
2. LFT shall communicate school holidays and public holidays before the academic year begins or when the contracted partners start classes with LFT.
3. Courses respect all national holidays, local and academic holidays that may occur throughout the academic year.

Absences
1. In case of illness contract partners are obliged to inform the academy of the absence by phone, in writing or by e-mail.
2. No recuperamos las clases para aquellos alumnos que las han perdido por razones personales. Solo se recuperan aquellas clases que LFT tiene que cancelar o posponer debido a circunstancias imprevistas.
10. Camps and Excursions abroad
LFT shall announce these events in an appropriate form and will obtain further explicit permission from the contract partners.
11. Insurance
By signing the Academy contract, the contract partners confirm that the student is insured against the consequences of accidents under the statutory health insurance. LFT has taken out basic accident insurance for academic courses at LFT. The contract partners provide the necessary insurance protection which is effective in Spain, including liability insurance in particular.
12. Liability
LFT shall not accept any liability vis-à-vis the student or third parties – in particular in the event of accidents, losses, personal injury, property damage and financial losses of any kind – to the extent legally permissible.
13. Information on adult students
LFT may inform the contract partners of an adult student of important school matters even without his/her consent if they pay the school fees.
14. Additional provisions of Learning First British School SL
LFT reserves the right to cancel courses of study, time variations, specialisations or modules if there are insufficient students or other circumstances that make it unreasonable to expect LFT to carry them out. Furthermore, LFT reserves the right to make changes to the courses of study or modules for important reasons while safeguarding the legitimate interests of registered students.
15. Final provisions
a. Should individual or several provisions of the academy contract, the General Terms and Conditions of Contract or their annexes be or become ineffective or invalid, this shall not affect the validity of the remaining provisions of the contract. The ineffective or invalid provisions shall be interpreted or replaced in such a way that they most closely approximate the intended purpose of these agreements in a permissible manner. The same shall also apply to any gaps in the contract.
b. Agreements between LFT and the contract partners as well as supplements and amendments there to require the written form to become effective.
c. Spanish law is applicable for all legal relations with LFT. The place of jurisdiction is the registered office and LFT also has the right to take legal action against the contract partners at their place of residence.
16. Protecciones de Datos
In accordance with the Organic Law on Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD 3/2018) and with the General Data Protection Regulation (RGPD UE 2016/679), we inform you that the personal data that could appear in this document or those that may be collected in the course of the relationship will be included in the files owned by Learning First British School SL. They may be communicated to third parties exclusively for the provision of the agreed service. The purpose of processing such data is to establish the contractual relationship with this Company. Legitimation is carried out through the consent of the interested party. You may exercise your rights of access, rectification, opposition, limitation, portability and deletion under the terms provided in current legislation or consult additional and detailed information on Data Protection by contacting the company.

My name is Meheraj Sultana and I am the director of the school, but I also teach Maths and English at Learning First Tenerife. I completed my higher education in the UK and have extensive experience working in London, as well as Spain. I have been teaching for many years and have experience teaching in a variety of settings with students of all ages and abilities, including children with special needs.
I consider myself to be an interactive and dynamic teacher and therefore the majority of my lessons are about doing practical and enjoyable exercises that students can understand and where possible, relate to in everyday life. I find that this drives motivation and interest in the subject and it creates a good teacher student rapport, which is essential in the learning process.
English is my first language and teaching it as a foreign language is an absolute joy. I have taught it in commercial language schools, secondary schools and institutions of higher education and in Industry. I place a strong emphasis on learning through dialogue and role play, I find that this is a fun and creative way of expression, which students usually enjoy participating in.
Having studied mathematics and teaching it for several years, it has now become second nature to me. However, I understand that many students enter my classroom with a not-so-favourable view of maths. I appreciate that it can be a challenging subject and my aim is for every student to become better ‘problem solvers’. Even if they do not learn every math concept, the ability to analyse and solve problems will carry with them throughout their lives.

My name is Kirsten Arentz and I am the German teacher at Learning First Tenerife.
I hava a degree in law but since 2001 I have been working as an German teacher. I am currently teaching adults, teenagers and children. I have worked in several schools, in further education institutions, for employees in hotels and other companies, as well as in the spanish “ Escuela Oficial de Idiomas“.
I enjoy teaching a lot and I find it very satisfying to see how my students improve their German language.
I try to teach my students in the most practical ways and to I try to motivate them to use the German language as much as possible in their everyday lives.
My name is Eva González, I am a child educator and I am in the last year of the Master’s degree in Primary Education. I have 7 years of experience working in children’s center’s teaching the little ones new knowledge and skills in a positive environment. I have also worked as a monitor at the summer camp at LFT.

After dedicating myself to translating and writing books, I decided to start to teach private French classes. I have been giving private French classes to people of all ages for two years. My classes are dynamic and enjoyable and from my experience of teaching, I have seen that enjoyment and motivation during class is key for students to progress quickly. My name is Fede and I am a native English teacher. I graduated in Social Work at the University of Turin in Italy. However, I realized after a few years that I have a big passion for teaching English. Therefore, I completed my first teacher training and I started my adventure as professional teacher. I have been traveling and teaching English since 2016 in several schools and language centres in Asia as well as Spain. During my journeys through amazing countries I also had the opportunity to work and volunteer for some NGO in which I cooperated with people from all over the world.
